Cancellation

2008 The
introduction of the Cancellation of
Contracts Made in a Consumer’s Home or Place of Work, Etc Regulations
2008, that are set to come into force on 1 October 2008. These
regulations are designed to help honest business by targeting rogue and
disreputable traders, with the aim of removing them from the market and
creating a level, competitive playing field. The
new regulations are likely to affect all traders who enter into a contract
with a consumer at their home or workplace, or another individual’s home,
or with the trader away from their business premises. For florists, this
may affect you if you do home visits for wedding flowers,
etc. The
regulations will extend the cooling off period and cancellation rights
which currently apply to contracts made during unsolicited visits by
traders, to contracts made during solicited visits. They also require cancellation rights
to be clearly and prominently displayed in written
contracts. Many
traders already provide these rights in contracts made during solicited
visits. The new law will be simpler and clearer for business, consumers
and enforcers to understand. Businesses will in general be able to work
with one contract, helping to reduce administrative and staff training
costs. Traders will need to read and understand the new regulations, and make any changes to comply. Those who don’t comply could find their contracts unenforceable and could be investigated by Trading Standards and prosecuted.
